(The definitions used in this announcement shall have the same meanings as defined in the announcement dated 30 April 2026 unless stated otherwise.)
Reference is made to the Company's announcement dated 30 April 2026 in relation to the Winding-Up Petition served on West River Engineering Sdn. Bhd.
The Board of Directors of WRB wishes to announce that WRE had through its solicitors, Messrs Ravi Moorthi, Noriza, Mala & Partners, filed a striking-out application to strike out and/or stay the said petition. The application is premised, inter alia, on the following grounds:-
- WRE has no privity of contract with the Petitioner and is not a party to any agreement for the hire of the mobile crane, the Petitioner having at all material times supplied the said mobile crane to Quantum Multiverse Sdn. Bhd. and not to WRE;
- WRE does not owe any debt to the Petitioner; and
- accordingly, the Petitioner has no locus standi to present the Petition and does not qualify as a creditor of WRE within the meaning of Section 464 of the Companies Act 2016.
A case management is fixed on 3 June 2026 before the Registrar in respect of the striking-out application and the hearing of the Winding-Up Petition is fixed on 1 July 2026 before the learned High Court Judge.
Any material developments in relation to the above will be announced in due course.
