Reference is made to our announcements dated 20 March 2015 and 17 June 2015 entitled "Internal Review"; 6 February 2018, 4 October 2018, 4 March 2019 and 30 October 2019 entitled "Writ of Summons and Statement of Claim"; as well as 28 May 2019, 11 July 2023, 28 December 2023, 22 January 2024, 11 March 2024, 7 June 2024, 4 July 2024 and 19 August 2024. entitled "Update on Civil and Criminal Charges against Michael Chua Khian Keng".

This is an update of the civil proceedings in the Court of Appeal pursuant to the announcement made on 4 July 2025 after the filing of the Notice of Appeals by both parties in July 2025. The Court of Appeal heard the consolidated appeals on 2 December 2025. The decision of the Court of Appeal was reserved to 5 March 2026, and thereafter postponed to 20 April 2026.

Decision in the Consolidated Appeals was delivered today, wherein Mudajaya' s Appeal was allowed with costs of RM150,000.00 and Michael Chua Khian Keng's Appeal was dismissed with costs of RM50,000.00.

The Court of Appeal decided that Mudajaya is entitled to the primary claim and the reliefs sought in the Statement of Claim. The earlier High Court Judgment sum of RM43,547,282.19 in favour of Mudajaya is now superseded by the higher award of RM72,195,919.86 (less any sums recovered).

This decision is not expected to have any material financial impact on the Group's earnings for the financial year ending 31 December 2026 until the Judgment Sum, interests and costs are fully repaid.

The Board and Management of the Company will make the necessary announcements to Bursa Malaysia Securities Berhad as and when there are further developments in relation thereof and/or upon receipt of any further directions from the Court.
