The above was fixed for case management (CM) today, 14 April 2026 before Yang Arif (YA) Puan Jamhirah binti Ali.
During CM, the Applicants' solicitors informed that the Applicants are not in the position to withdraw both proceedings, i.e. the proceedings in PW279 (Insolvency Court 2), to stay the Winding-Up Order under section 492 and the above proceedings in PW745 (Insolvency Court 1), to terminate the Winding-Up Order under section 493.
The Applicants' solicitors explained further that the stay application in PW279 is essentially pegged to the termination application in PW745 as it is an application for a stay pending, inter alia, the filing or disposal of the termination application. These are matters which are to be decided by the Insolvency Court 2 during the hearing fixed on 13 July 2026.
The Order obtained in PW279 is only an Ad Interim Order to stay the Winding-Up Order pending the disposal of the stay application. It does not set aside or annul the Winding-Up Order. Therefore, there is a basis to continue with the above proceedings for the Winding-Up Order to be terminated.
The Court gave the following directions:
- 13 May 2026 for the Liquidator to file their Report to Court and all Creditors (in support of or in opposition to the termination application) to file their respective affidavits in reply;
- 15 June 2026 for the Applicants to file affidavit in reply;
- 29 June 2026 for the Applicants and the Creditor in support of the termination application to file written submissions;
- 20 July 2026 for the Liquidator and the Creditors in opposition to the termination application to file submissions in reply; and
- 3 August 2026 for the Applicants to file submissions in reply.
The Court fixed the above for hearing of Enclosure 1 on 11 August 2026 at 10:30 am.
