Refer to the Company's announcements made on 9 June 2025, 10 June 2025, 11 June 2025, 19 June 2025, 23 June 2025, 25 June 2025, 15 July 2025, 23 July 2025, 27 July 2025, 28 August 2025, 25 September 2025, 9 December 2025, 6 January 2026, 7 January 2026, 27 January 2026, 13 February 2026, 10 March 2026 and 16 March 2026.
The above was fixed for case management (CM) today, 31 March 2026 before Yang Arif (YA) Puan Jamhirah binti Ali in respect of the following:
(i) Enclosure 13, i.e. Motion to Transfer the above to be heard by the learned Judge in PW279; and
(ii) Enclosure 1, i.e. Motion to Terminate the Winding Up Order.
The Applicants' solicitors informed on the Applicants' instructions to withdraw Enclosure 13 and the matter is fixed before YA as parties could not agree on the issue of costs. After hearing submissions from the parties, YA awarded total costs of RM5,000, i.e. RM2,500 for each set of creditors, for the withdrawal of Enclosure 13.
The Applicants' solicitors also informed YA on the status of PW279 that there is an Ad Interim Order for a stay of the Winding Up Order pending the disposal of Enclosure 1 therein ("the Interim Stay Order").
YA then directed the Applicants' solicitors to obtain their clients' instructions on whether to proceed with the Stay Motion in PW279 or the Termination Motion in the above. YA is of the view that either one of the said proceedings would have to be withdrawn.
In particular, the purpose of the Motion to terminate the Winding Up Order in the above cannot be realised when the said Winding Up Order has been stayed. Further, in view of the Interim Stay Order, the Liquidator is unable to proceed to prepare its Report for the Court in the above to consider whether the Winding Up Order can be terminated.
YA fixed 14 April 2026 as the next CM for solicitors of the Applicants to update the Court on whether the Applicants are withdrawing the above or the Stay Motion in PW279.
